Terms of Service

These Terms of Service ("Terms") govern your access to and use of SPAKO, including the SPAKO mobile application and www.getspako.com (together, the "Service"), provided by SPAKO ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Who can use SPAKO

You must be at least 13 years old (or the minimum age required in your country) to create a SPAKO account. By using the Service you confirm you meet this requirement and that you're not barred from using the Service under applicable law.

2. Your account

You're responsible for the activity on your account and for keeping your login credentials secure. Let us know right away if you believe your account has been compromised.

3. Content you post

You keep ownership of the photos, videos, songs, messages, and other content you post to SPAKO ("User Content"). By posting User Content, you grant SPAKO a worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate and provide the Service — for example, showing your post in the feed, delivering your messages, or playing a song you've uploaded through the sound library.

You're solely responsible for your User Content. You agree not to post anything that's illegal, infringes someone else's rights, or violates our community guidelines.

4. Artist & music uploads

If you upload music to SPAKO as an artist, you confirm you own the rights to that music or have the necessary permissions to upload and distribute it through the Service, including making it available in the shared sound library for other users to attach to their own posts. Once uploaded, songs can only be removed from SPAKO by a SPAKO administrator — contact us at hello@getspako.com to request removal of a song.

5. Payments, tips, and advertising

SPAKO is free to download and use. Some features involve real payments processed through Stripe, our third-party payment processor:

• Tips — users can tip creators. SPAKO retains a 30% platform fee; the creator receives 70%.
• Ad revenue share — where a creator's content carries an advertisement, ad revenue attributed to that content splits 50/50 between the creator and SPAKO.
• Advertising — anyone may submit a paid advertisement for review. Approved ads are charged for the selected plan up front. SPAKO reviews every ad before it goes live and may reject or remove ads at its discretion.

All payments are subject to Stripe's own terms in addition to these Terms.

6. Prohibited conduct

You agree not to misuse the Service — including harassment of other users, posting content that violates the law or third-party rights, attempting to disrupt or reverse engineer the Service, or using the Service for unauthorized commercial purposes.

7. Termination

You may stop using SPAKO and delete your account at any time. We may suspend or terminate access to the Service for any account that violates these Terms.

8. Disclaimers & limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, SPAKO is not liable for indirect, incidental, or consequential damages arising from your use of the Service.

9. Changes to these Terms

We may update these Terms from time to time. We'll post the updated Terms with a new "Last updated" date; continued use of the Service after a change means you accept the updated Terms.

Privacy Policy

This Privacy Policy explains what information SPAKO ("we", "us") collects through the SPAKO app and www.getspako.com, and how we use it.

1. Information we collect

• Account information — phone number (used for OTP login), display name, username, profile photo, and bio.
• Content you create — messages, photos, videos, stories, songs, comments, and likes.
• Usage data — things like play counts, download counts, and basic app activity needed to operate features like the sound library and creator earnings.
• Payment information — when you tip, get tipped, or place an ad, payment details are collected and processed directly by Stripe. SPAKO does not store your full card number.
• Device & connection information — basic technical data (device type, connection quality) used to keep calls and uploads working reliably on slower networks.

2. How we use this information

We use the information above to operate the Service — for example, to deliver your messages and calls, show your posts and stories to the right people, calculate and pay out creator earnings, process tips and ad purchases through Stripe, and moderate content that violates our Terms.

3. What we share

We don't sell your personal information. We share information only:

• With Stripe, to process payments;
• With other users, to the extent you choose to share it (e.g. your profile, posts, and stories are visible per the audience you select);
• When required by law, or to protect the safety of SPAKO users.

4. Data retention

We keep your account information for as long as your account is active. Stories are automatically removed 24 hours after posting. If you delete a piece of content, it's removed from your profile and the feed; some records may be retained where needed for legal, security, or accounting purposes.

5. Your choices

You can update your profile information, delete individual pieces of content, or delete your account at any time from within the app. Artists: songs can no longer be removed directly from the app — contact hello@getspako.com and a SPAKO admin will take it down for you.

6. Children's privacy

SPAKO is not directed at children under 13, and we don't knowingly collect information from children under 13. If you believe a child has created an account, contact us and we'll take appropriate action.

7. Security

We use industry-standard measures to protect your information, including encrypted connections and access controls. No system is perfectly secure, and we can't guarantee absolute security.

We may update this Privacy Policy from time to time. We'll post the updated policy with a new "Last updated" date.
